HBT: Cards start fast, then hold off Giants in Game 1

The Cardinals overcame a 6-0 deficit to claim Game 5 of the NLDS against the Nationals. On Sunday, they found themselves with a 6-0 lead and then held on to beat the Giants 6-4 in the first game of the NLCS.

David Freese and Carlos Beltran hit two-run homers for the Cardinals as they built their six-run lead and knocked Madison Bumgarner out in the fourth. The rout was very short lived, though, as the Giants came right back with four runs in the bottom of the fourth,?resulting?in Lance Lynn?s removal from the game.

Both bullpens matched zeroes from there, with neither offense able to score. Tim Lincecum pitched two scoreless innings for San Francisco, but five Cardinals relievers threw scoreless innings, with Edward Mujica getting credited with the victory after striking out the side in the seventh,

The Cardinals have to be feeling very good about the win, with their replacement starter ? Lynn was inserted back into the rotation in place of the injured Jaime Garcia ? beating the Giants? No. 2. Now they get to throw Chris Carpenter against Ryan Vogelsong in Monday?s Game 2 in San Francisco.

Illustrious Dreams

Today I had a very intriguing, but weird dream. The dream took me on a adventure so fulfilling, that after I woke up to this boring reality we call life, I was instantly overcome with sadness. An empty void now inside my heart, I began seeking to fill it with something of equal value. But to no avail; I was not successful in my hunt. This left me with but one option... to recreate this world myself.

At its most basic description the dream was about underground pirates, literally. In this world there was these underground tunnels or sewer systems called the Sub Straits, in which people would brave in search of treasure or old functioning technology. In this sense, they are more scavengers than they are your traditional pirates. But I use the term pirates because they traverse these tunnels, which are the size of large rivers, in makeshift sea-faring vessels.

I would base the roleplay around that activity and of course limit it to the adventures of one crew. What makes this different from any other pirate adventure, would of course be the world it is based in. Whether the Sub Straits span across an entire planet or just one area, I have not decided yet. But I figured I would decided that later. The technology level of the world would be something futuristic and a mixture of arcanepunk, think Shadowrun. I would also be including 5 unique races and 3 class types, there will also be character roles relating to titles and duties aboard the ship. Getting back to the races and classes though, as I said the world be influenced by Shadowrun and the Arcanepunk genre. Meaning we will have fantasy races, like Elves and Dwarves using Guns and Magic.

As far as the plot and story goes, that will depend upon the history of the world and what exactly these Sub-Straits are. But, obviously it would be centered around the journey of our characters as a crew. I do want to stray away from cliches and try to make the origin story as unique as possible; that goes for the quest they are on too. I was thinking, maybe the crew are actually a bunch of criminals who escape into the tunnels and end up on some whirlwind adventure? I also want he characters to exist in more than one dimension and be well thought out.

Anyway, this was just a spur-of-the-moment type thing as it is all based on a dream. Previously, I was devoting all my spare time to the completion of a larger scale roleplay. But if this can generate enough interest, I will place the other on hold and focus on this instead. So, if any of you like where I am going with this and would like to be part of it, let me know by posting your thoughts and ideas.

Israeli air strike in Gaza kills Palestinian militant

Gaza (Reuters) - An Israeli air strike in Gaza killed a Palestinian gunman and wounded another on Sunday, hospital officials said, hours after Israel killed the leader of an al Qaeda-linked militant group.

An Israeli military spokesman said the men targeted had been preparing to fire rockets into Israel.

The air strike, which targeted a motorcycle in southern Gaza, came hours after Israel killed two other militants in a similar attack late on Saturday.

Both Hamas, the Islamist group that rules Gaza, and Israel identified one of the men killed in the earlier attack as Salafi jihadist Hisham Al-Saedni.

Hamas said Saedni had headed Tawhid and Jihad (One God and Holy War), a group with an Islamist ideology shared by al Qaeda, while the Israeli military said he had helped found a kindred militant Salafi movement, the Hashura Council of the Mujahideen.

Saedni had recently been planning a attack that would be carried out in the neighbouring Egyptian Sinai, the Israeli military said in a statement. The desert peninsula has seen a surge of Islamist militant activity during the political upheaval rocking Cairo since early 2011.

A number of Jihadist Salafi groups have surfaced in Gaza in recent years. Unlike Hamas, they endorse an ideology of global Jihad and some accuse Hamas of failing to implement Islamic laws in the coastal enclave.

Hamas rejects permanent peace with Israel and the two sides fought a three-week war from December 2008 into January 2009. The border is tense with frequent clashes. About 40 rockets have been fired from Gaza into Israel in October.

Israel says it holds Hamas responsible for any attacks launched from Gaza, which has been under the group's control since 2007.

The Martian rock, a form of basalt, has a composition very similar to volcanic rocks found in ocean-island settings such as Hawaii and the Azores, as well as in rift zones ? regions where Earth's continents split and begin separating into separate land masses.

The rock, named Jake Matijevic for a key member of the rover engineering team who passed away shortly after Curiosity arrived on the red planet, can form in a number of ways, says Edward Stolper, provost of the California Institute of Technology in Pasadena and a member of Curiosity's science team.

On Earth, this kind of rock forms as magma cools and crystallizes under relatively high pressure and with relatively high concentrations of water dissolved in the magma, he explains, adding that when the molten leftovers erupt, they tend to erupt explosively.

The release, during volcanic eruptions, of water dissolved in magma is one pathway for water vapor ? a greenhouse gas ? to enrich and warm a planet's atmosphere. Indeed, Curiosity's mission aims to see if Gale Crater ever could have hosted microbial life ? a prospect that would have required the presence of liquid water in the crater.

On Mars, the process that formed ?Jake? is unclear.

"We have one rock," Dr. Stolper said at a briefing Thursday. Sitting on the floor of Gale Crater, where fine soils and layered, sedimentary rocks seem to be the norm, Jake appears to be an interloper, removed from its original geologic setting.

If Curiosity finds more rocks like Jake in its travels to Mt. Sharp, the crater's central summit and the rover's ultimate destination, "we'll be able to evaluate the differences between them and what processes seem to relate them," he said. But if Jake is "a one-off,? he added, ?we're not going to find out the details" of how it formed.

The analysis of Jake's chemical composition comes from data gathered in late September by two tools mounted on Curiosity: ChemCam and an X-ray spectrometer on an instrument turret at the end of the rover?s seven-foot-long arm.

ChemCam, which sits atop Curiosity's mast, consists of a laser that sends a thin, pulsed beam to vaporize tiny patches of rock, each pulse generating what looks like a brief spark on the rock surface. ChemCam's mini-telescope captures the light from the sparks ? light whose spectrum carries the signatures of the chemical elements the rock contains.

ChemCam examined two small areas of the football-sized rock. In one, it laid down a short track of five strike marks, each about a third of a millimeter across. In the second, the laser put down a grid of nine spots. Each got 30 pulses ? the first four of which clear the rock surface of dust.

The X-ray spectrometer, known as APXS, uses a radioactive source to expose the rock sample in question to X-rays. When the X-rays interact with atoms in the rock, those atoms release X-rays of their own, which carry the element's signature. APXS detects these back-atchya X-rays to tease out information about the sample's composition.

Each instrument detects some chemical elements better than others, but together, they form a powerful team while crosschecking each other's results. The time spent zapping Jake was APXS's first live-fire exercise on Mars and the first time the two were used to analyze the same rock.

Because other rovers and landers have carried X-ray spectrometers, researchers were able to determine that Jake was unique among the basaltic rocks scientists have analyzed so far on the red planet.

While researchers analyzed the results from Jake, engineers have started to clean out the hardware needed to feed rock and soil samples into two key instruments housed in Curiosity's chassis. On Mars, it seems, clean hardware is dusty hardware.

Essentially, engineers used Martian soil scooped, vibrated, and sieved, to clean unavoidable terrestrial residue from the inside walls of the sample-delivery system.

"We don't want to measure something we brought with us, we want to measure something that came from Mars," says Luther Beegle, the rover's sampling-system scientist as NASA's Jet Propulsion Laboratory in Pasadena.

The way to tell that the scrub-down is working? Dust clings to the inside surfaces of the sample-delivery system, known as CHIMRA.

In his third movie, Argo (Warner Bros.), actor-director Ben Affleck pulls off a nifty trick. He takes a little-known but incredible true-life story?the clandestine CIA rescue of six stranded Americans during the 1979-81 Iran hostage crisis?and turns it into a rip-roaring Hollywood thriller, complete with romance, a comic subplot, and a car chase or two. Argo isn?t quite on the level of the Sidney Lumet classics to which Affleck pays stylistic homage?smart and taut as it is, it lacks the broader political vision of a film like Dog Day Afternoon. But Lumet lite still goes down pretty smooth.

The events Argo recounts took place a few months after demonstrators laid siege to the U.S. Embassy in Tehran, taking 52 diplomatic employees prisoner for what would turn out to be well over a year. Argo sets up this takeover with an opening montage that cleverly deploys old news footage, storyboard panels, and voice-over to fill in the complex back story?it goes all the way back to 1953, when the United States and Britain backed the coup that installed an authoritarian Shah. After the Shah fled Iran during the Islamic revolution, eventually seeking medical treatment in the United States, Jimmy Carter refused to extradite him to his home country to stand trial.

It?s on an image of the resulting chaos?an image re-created almost verbatim from news photographs of the time?that the movie proper begins: an angry mob just beginning to scale the walls of the embassy compound. Inside, terrified workers shred documents and destroy sensitive materials, knowing it?s only a matter of time till they?re captured or worse. (These early scenes? unintended resonance with the recent attack on the diplomatic mission in Libya makes the sitting-duck tension even harder to tolerate.) In the tumult following the attack, it?s at first hard to follow just which hostages have been spirited where. But soon enough Bryan Cranston, playing a CIA bigwig, appears to explain it all to us (and to the ill-equipped State Department staff): As the embassy siege began, six foreign-service workers escaped out the back door and managed to make it to the residence of the Canadian ambassador (Victor Garber), where for months they?ve been holed-up indoors.

Each proposed plan to extract the group sounds lamer than the last, from sending a military team on a 300-mile bicycle trip across Iran?s closed borders, to passing off a group of spies as visiting English teachers. (This in a country where all English schools have just been shuttered.) Finally, CIA ?exfiltration? expert Tony Mendez (Affleck), after catching a few minutes of a Planet of the Apes movie on TV, contrives what Cranston grudgingly admits is ?the best bad idea we?ve got?: What if the six houseguests pose as a Canadian film crew who?ve traveled to Iran to location-scout for a Star Wars-style space epic? If someone could manage to supply them with fake Canadian passports, couldn?t they simply head to the airport and fly out? As one skeptic derisively observes, Mendez?s plan comes from the long-standing ?so crazy it just might work? school of problem-solving.

The second 20 or so minutes of the film amusingly track the process by which Mendez scrambles to establish the plan?s credibility. He enlists his buddy, a Hollywood makeup man (John Goodman at his most endearing) along with a washed-up movie producer (Alan Arkin at his most mordantly hilarious) to option an existing script and set up a fake production office, even going so far as to take out an ad in the trades for their upcoming production, Argo. (Tagline: ?A Cosmic Conflagration.?) A scene in which Arkin?s character expertly strong-arms a competing producer (Richard Kind) into giving up the rights to the Argo script is a deliciously effective, and affectionate, piece of Hollywood satire.

There?s a nicely executed transition from this comic interlude to the ratcheted-up tension of the film?s second half. After negotiating a maze of bureaucracy on both the D.C. and Tehran fronts, Mendez makes it to Iran, where he grills the freaked-out houseguests on the contents of their fake r?sum?s as the Iranians steadily close in on their whereabouts. Even if you go in knowing the details of how the operation turned out (I didn?t, precisely), you can?t help but break into a cold sweat during the climactic checkpoint encounter, or thrill to the car-on-plane chase down the runways of Tehran?s Mehrabad Airport?one of a few scenes in which screenwriter Chris Terrio?s broadly accurate retelling of real events allows itself some fairly whopping dramatic license.

But Argo provides just enough grit to sand down the edges of the audience?s disbelief. We?re not here for an episode of Frontline: We?d like a little emotional catharsis with our late-20th-century history lesson, and Affleck generously provides it in the movie?s last act, when Mendez?s character and the resilience of the houseguests are put to the test. One could wish that the movie contained at least one significant Iranian character?the locals we encounter are pretty much restricted to the ?menacing thug? or ?loyal servant? variety?but there?s no pandering to negative stereotypes of Islam, and the opening voice-over treats the history of American meddling in Middle Eastern affairs with frank disdain.

Argo is a rollicking yarn, easily the most cohesive and technically accomplished of Affleck?s three films so far, but a part of me wishes the director hadn?t cast himself in the lead role. It?s not that he?s terrible as Agent Mendez?we believe in his intelligence and commitment to his task, and he even gets off some dryly funny punch lines. But the character remains something of an emotional cipher, and not in a mysterious way, just in a dull one. An older, less callow actor?George Clooney, Brad Pitt, or (to get crazy and cast an actual Latino) Benicio Del Toro?might have brought more texture and darkness to the role of this quiet, driven man, a work-obsessed loner who?s ?taking a break? from his wife and young son. The night before Mendez and the houseguests make their big break for the airport, Affleck gives us a dusk-to-dawn montage of Mendez alone in his hotel room, smoking cigarettes and drinking whiskey as he wrestles with whether or not to go through with the plan. With the right actor, this wordless interlude could have made for a powerful existential mini-drama: the dark night of the CIA-agent soul. Instead, it just sort of felt like watching Ben Affleck get hammered.

Geithner: US economy growing despite headwinds

TOKYO (AP) ? U.S. Treasury Secretary Timothy Geithner said Thursday that financial reforms and other actions in response to the global crisis are yielding results, helping the U.S. economy to grow at a pace better than there was reason to expect.

Speaking at a financial conference in Tokyo on Thursday, Geithner said the Obama administration would strive to resolve by the end of the year the impasse with the Congress that threatens to impose a so-called "fiscal cliff" of tax increases and deep spending cuts if the two sides do not reach agreement.

The U.S. has been relatively successful in managing to clean up the mess left by the 2008 financial crisis while not starving the economy of credit, Geithner said. Growth has dragged, though, due to the European crisis and severe drought across the U.S.

"We've been relatively successful in doing these reforms in a way that didn't starve the economy of credit," he said.

Growth has averaged just over 2 percent a year since 2009, lower than the 3 percent to 4 percent that many had forecast, he said. Geithner put the impact from the European slowdown at up to 1 percentage point of GDP growth and from this year's drought at about 0.5 point.

"Those two factors alone explain the difference," he said.

"From my perspective, the U.S. economy is doing significantly better than anybody had reason to expect, not just because of the magnitude of the crisis but because of the size of the force of the shocks that hit the U.S. economy," Geithner said, pointing to the European debt morass and two spells of surging oil prices.

The Obama administration did well to act aggressively and early on financial reforms and recapitalizing financial institutions, Geithner said, though he acknowledged there was much work ahead, especially on reforming housing finance ? which was at the heart of the collapse in 2008.

"Mortgage credit in the United States is tighter than it needs to be," Geithner said.

Progress made in getting the economy back on track could be undone, economists have warned, if Washington fails to deal effectively with the so-called "fiscal cliff."

Christine Lagarde, managing director of the International Monetary Fund, urged that the U.S. take "decisive action" on the issue.

Geithner acknowledged the urgency of the problem, saying the Obama administration intends to try to resolve its standoff with the Republican-controlled Congress over spending limits by the end of the year. The aim is to draw up a set of reforms that could be phased in over time.

If the impasse is not resolved by 2013, tax increases and deep spending cuts amounting to up to 4 percent of GDP will take effect, walloping the U.S. economy. The IMF has urged the U.S. to raise the ceiling on the level of debt the government can issue, which is capped by law and avoid a showdown similar to that in August 2011, when a similar impasse went unresolved until the U.S. almost defaulted on its debt.

Deferring the problem is not a "responsible strategy," Geithner said.

"It might feel like an easy path at the moment but it will still leave a set of big questions hanging over the country. I don't think that will help."

The Fiscal Cliff

You may have heard discussions regarding the U.S. approaching a ?Fiscal Cliff? at the end of this year. If you?re a current client of SFA, you heard us start talking about it in June of this year! If Congress doesn?t act, taxes will rise and government spending will shrink starting in January of 2013. These austerity measures could push the U.S. economy into recession in 2013, following Europe?s path.

Many believe this year?s elections could shape the direction of tax policy and government spending for future years; so tax debates are likely to escalate (PLEASE VOTE!!) For our clients who are worried the U.S. cannot continue to run high deficits indefinitely, the fiscal cliff might be welcomed despite it?s extremely aggressive shift toward deficit reduction. However, such abrupt changes almost certainly will have large negative impacts on the economy and the markets, although most everyone agrees that the deficit must be reduced over time.

In the face of these changes, the composition of possible tax increases and their amounts remains uncertain. We are preparing our clients for higher taxes as it?s almost a foregone conclusion that they are on the rise. A solid strategy will address the uncertainly about taxes in the future through an appropriate mix of tactics.

A few considerations include:

  • Fully funding tax-deferred investments such as IRAs, 401(k) plans and education savings plans.
  • Roth IRA conversions (?bumping the bracket? strategy)
  • Moving away from volatile vehicles like stocks and Variable Annuities and into safer strategies such as Indexed Annuities.

Zimmerman's brother goes on Twitter tirade in Trayvon Martin case

ORLANDO, Florida (Reuters) - The brother of the Florida man charged in the shooting death of teenager Trayvon Martin took to Twitter to criticize a lawyer involved with the case, which could complicate the accused murder's legal defense.

Robert Zimmerman Jr., whose brother George Zimmerman faces up to life in prison, recently appeared on several TV and radio shows complaining about a "vast mis-information campaign," as well as highlighting an "official letter of condolence" to Trayvon Martin's family.

George Zimmerman, who is white and Hispanic, is charged with shooting and killing the unarmed, black Martin as he walked through a gated community in Sanford, Florida, in February.

After Robert Zimmerman Jr. appeared Monday on CNN's Piers Morgan Tonight, an Orlando civil rights lawyer Natalie Jackson suggested the family was using the media for fundraising.

Jackson was one of a group of lawyers and supporters who helped bring public pressure to bear on police and prosecutors for not immediately charging Zimmerman after he shot 17-year-old Martin.

Jackson's comment prompted a twitter tirade by Robert Zimmerman Jr. who wrote to Jackson: "My Life's work = you WILL be held accountable for your words/actions. You A'INT seen NOTHIN' yet ... I will see U disbarred."

George Zimmerman has said the shooting was self-defense and justified under Florida's "Stand Your Ground" gun law.

"We're naturally concerned about anyone associated with the case speaking publicly, because there is always a risk that their comments could complicate our defense efforts," Zimmerman's lawyer Mark O'Mara told Reuters in an emailed statement.

O'Mara previously called "ill-timed" a book and television appearances in September by George Zimmerman's friend Mark Osterman. Osterman revealed details of the shooting that he said were drawn from conversations he had with Zimmerman and his wife while they stayed in his home for several weeks after the killing.

Benjamin Crump, an attorney for the Martin family, said the tweets by Robert Zimmerman Jr. could play into the hands of prosecutors if he is called as a witness.

Robert Zimmerman Jr. is one of several friends and family members who say George Zimmerman told them what happened the night of February 26 when he killed Martin. Prosecutors could use that in court as they claim Zimmerman has not been consistent with his version of events.

"When they go to testify your character and your credibility is at issue so I think these (Twitter) comments could have an effect," Crump said.

Say Anything Supreme Court Considering Whether Or Not It's Legal ...

From garage sales and thrift stores to eBay and Craigslist, re-selling used stuff is a huge industry. In fact, in the internet age, I think it?s something that has made our economy more resilient. The internet market for used stuff has made said stuff more valuable. Never before has stuff we don?t want or need any more been more valuable, if only because it?s cheap to market it to a big potential market for re-selling it.

But now the Supreme Court has before it a case that questions whether or not re-selling some of that stuff is legal:

At issue in Kirtsaeng v. John Wiley & Sons is the first-sale doctrine in copyright law, which allows you to buy and then sell things like electronics, books, artwork and furniture, as well as CDs and DVDs, without getting permission from the copyright holder of those products.

Under the doctrine, which the Supreme Court has recognized since 1908, you can resell your stuff without worry because the copyright holder only had control over the first sale.

Put simply, though Apple Inc. AAPL +0.26% has the copyright on the iPhone and Mark Owen has it on the book ?No Easy Day,? you can still sell your copies to whomever you please whenever you want without retribution.

That?s being challenged now for products that are made abroad, and if the Supreme Court upholds an appellate court ruling, it would mean that the copyright holders of anything you own that has been made in China, Japan or Europe, for example, would have to give you permission to sell it.

?It means that it?s harder for consumers to buy used products and harder for them to sell them,? said Jonathan Band, an adjunct professor at Georgetown University Law Center, who filed a friend-of-the-court brief on behalf of the American Library Association, the Association of College and Research Libraries and the Association for Research Libraries. ?This has huge consumer impact on all consumer groups.?

Earlier this year my wife and I decided to buy ourselves tablets. She wanted an iPad, I wanted the Google Nexus 7. In order to make room for these purchases in our budget, we sold some old gadgets we weren?t using any more online. Had we not been able to do that, we probably wouldn?t have bought our new gadgets.

I think that?s how a lot of consumers operate these days, offsetting the cost of new purchases by selling off old purchases, but if the market for selling off old stuff is eliminated or even just greatly diminished?well, the economic implications are enormous.

This case actually originates with a college student from Taiwan who, noticing that John Wiley & Sons were selling textbooks in his home country for a lot less than here in the United States, had his family buy up textbooks there for sale here. He eventually made some serious bank on this deal ? $1.2 million ? but Wiley objected invoking copyrights. Wiley counted with the first-sale doctrine, but a lower court held that the doctrine only applies to American-made goods sold in America.

Which would mean that pawnshops and online sellers around the nation are potentially violating copyright laws by selling used foreign-made goods.

If the Supreme Court upholds the lower court?s rather broad ruling on this issue it could mean a very, very different American economy.

Property Tax Program Offered Free by Purdue On Line

Larry DeBoer, Purdue University agricultural economics professor, will discuss ?On Local Government: The 2012 Property Tax? Monday, Oct. 15, from 11 a.m.-1 p.m.

This free program will be delivered via video streaming and can be viewed from multiple locations across the state, including the Purdue Extension Franklin County office or a personal computer. Persons who register will receive the link.

All individuals involved in county and local government budgeting (county councils and commissioners, mayors and city councils, town boards, school boards, library boards and townships) are invited.

In 2012, for the first time in years, property tax rates, revenues and tax bills were not affected by statewide policy changes. The big 2008 tax reform was fully phased in by 2011. There were some statewide trends. The effects of the recession lingered in many counties, depressing assessed value growth. Taxes in rural counties were affected by a large increase in farmland assessed values. DeBoer will discuss the state of the Indiana property tax in 2012, and will look in particular at the Legislative Services Agency?s county-by-county property tax reports.

Reyes Holding LLC has filed a motion to intervene as well as a motion to dismiss/judgement on the pleadings in the Chesbay matter.??? Reyes argues that it is entitled to intervene as a matter of right as an affected party under FRCP 24.???? Reyes notes that it qualifies under the rule because it ?claims an interest relating to the property or transaction that is the subject of the action, and is so situated that disposing of the action may as a practical matter impair or impede the movant?s ability to protect its interest.?

Furthermore, provided they are granted the right to intervene, Reyes has filed a motion to dismiss the case or in the alternative,for judgement on the pleadings.??? In arguments that further the arguments of Chesbay,? Reyes notes that the Lanham Act does not preempt state laws, there is no breach of contract, MillerCoors has waived any potential breach,? the VA beer Franchise controls this matter, and?finally notes?there is the 21st Amendment to be considered.

The motions also contained many affidavits and exhibits highlighting the public statements of MillerCoors professing that state law would control in any dispute and the repeated awards/approvals by MillerCoors?for the Reyes Companies and their MillerCoors beer distribution?businesses.?? It is unclear what theory or facts?MillerCoors will pursue to justify their claims, especially the Lanham Act claim.

Well?we posted some generalized thoughts a few hours?ago and they are already out of date as later this afternoon Chesbay filed its Motion to Dismiss in federal court.? As they explain in their memorandum in support of the motion to dismiss, Chesbay believes the court should dismiss the complaint on?at least seven different basis?;? 1) MillerCoors fails to state a claim? as the Virginia Beer Franchise Act is incorporated into and supersedes any conflicting provision of the MillerCoors? Contract;? 2) MillerCoors fails to claim that Chesbay has failed to meet the requirements of the Virginia Beer Franchise Act in any way; 3) MillerCoors? claim of breach of contract fails?as a matter of law as it is based on provisions superseded by the Virginia Beer Franchise Act; 4) MillerCoors? Lanham Act claim fails because they assert opinion, not specific legal claims necessary for pleading; 5) MillerCoors? preemption claim is without merit as a matter of law based on well settled preemption case law including very relevant cases in the 4th Circuit; 6) Chesbay points out that this court doesn?t need to get to the 21st Amendment to engage in any balancing of interests analysis because of the previous six arguments;? 7) Finally, Chesbay points out that they are properly using MillerCoors? trademark now and there is no allegation that this matter would suddenly create any ?confusion? to the consumer, a necessary element of a claim.

The ball is?back in MillerCoors? court.

There has been much industry discussion regarding the Amended Complaint filed by MillerCoors in the Chesbay litigation.? Obviously, there has not been much?insight on why this theory was advanced by Miller Coors nor are we privy to the corporate/legal thinking behind this approach. Also, we are not sure of the cost/benefit ratio analysis of uniting the American beer distribution industry against the course of action chosen by MillerCoors.?? Nevertheless, it is filed. What next?? ?As with everything here on this site, these are some quick and partial observations and not legal advice on this much discussed case.? The litigation itself will smoke out more detail.

First of all the ?Rocket Docket? of the Eastern District of Virginia won?t tolerate much delay as the median time between complaint and trial in this federal district court is only 11.3 months, the fastest of any district court in the country.? Despite the coverage in press or statements, the court calendar marches on with a strong prejudice against delay.

Many are doubtful of MillerCoors chances as there are at least two probably fatal flaws for MillerCoors to advance this theory.?? 1). There is a strong presumption against preemption and no obvious theory of preemption applies here (there is no express, implied or conflict preemption).? Although the Lanham Act (regulating trademarks) does have a preemptive section, its text clearly does not apply to this case.??The Virginia Beer Franchise Act (not mentioned in either of MillerCoors complaints) is not in conflict with this federal statute in any way.? ?Also, MillerCoors already allows
the prospective purchaser the right to use the very same trademark in dispute in the very same state of Virginia.? This distributor also happens to sell the most MillerCoors beer in the country.? 2)? A quick review of the case law again illustrates the weakness of MillerCoors? preemption claim.? For example, in Mobil Oil Corp. v. Virginia Gasoline Marketers & Automotive Repair Ass?n, 34 F.3d 220 (4th Cir.1994), cert. denied, 513 U.S. 1148 (1995) the 4th Circuit held the Lanham Act did not preempt a Virginia law governing service stations/ supplier relations. ?The Chesbay lawsuit filed in the Eastern District is in the very same 4th Circuit. ??And we can add a tentative third point. 3) If Miller Coors does somehow make it through the first two hurdles, there is of course the 21st Amendment?which grants states the primary right to regulate alcohol.??The 21st Amendment shouldn?t even be a factor in this case but theoretically it could come in as an additional consideration down the road. The Supreme Court has noted that states have ?virtually complete control? under the Twenty-First Amendment ?over . . . how to structure the liquor distribution system.? Cal. Retail Liquor Dealers Ass?n v. Midcal Aluminum, Inc., 445 U.S. 97 (1980) and that state laws ?are supported by a strong presumption of validity and should not be set aside lightly.? North Dakota v. U.S., 495 U.S. 423, 433 (1990).

Since this court expects action and abhors delays, there will be updates on a regular basis. We?ll post updates as we get them.

(Earlier Post)? MillerCoors Tries Federal Preemption Play in Virginia

MillerCoors has amended its complaint in federal court in the Eastern District of Virginia trying to bar the sale of the Chesbay Distributing Company to another Virginia distributor.? MillerCoors now claims that the Lanham Act preempts state laws.?? Although, neither the amended complaint nor the original complaint cite to or even?acknowledge the presence of the Virginia Beer Franchise Act, the Amended Complaint claims preemption of ?state law? that requires the assignment of licenses.???One of the?Virgina statutes presumably sought to be preempted by the supplier:? 4.1-507. Transfer of business.?A. No brewery shall unreasonably withhold or delay consent to any transfer of the wholesaler?s business, or transfer of the stock or other interest in the wholesalership, whenever the wholesaler to be substituted meets the material and reasonable qualifications and standards required of its wholesalers.

MillerCoors has tried to have it both ways on its controversial proposed?supplier?agreement it issued following the joint venture in 2008.? On one hand it has repeatedly told everyone that would listen, ?state law controls? when it comes to conflicts between state laws and their?proposed contract.? On the other hand they make the argument filed today which contradicts those pronouncements and have in other forums tried to deflect attention to how the proposed supplier agreement violates state law.? Past adjudications have not been favorably inclined to support the MillerCoors attempts to remain selectively vague, for example here is a ruling in Michigan disagreeing with the MillerCoors view on how the contract attempted to treat the sale of? a distributorship.

Napoli beats Sampdoria 1-0 to rejoin Juve in lead

ROME (AP) - Napoli rejoined Juventus at the top of Serie A with a 1-0 win at 10-man Sampdoria on Sunday, as the southern club seeks its first Italian title since Diego Maradona first led it to glory.

Edinson Cavani converted a penalty for Napoli in the 67th minute for his league-best sixth goal of the season.

Daniele Guastaldello was given his second yellow card for tripping Marek Hamsik at the edge of the area to set up the penalty.

Replays showed that the penalty may have occurred just outside the area.

"It was on the line, and the line is part of the penalty area," said Napoli manager Walter Mazzarri, who was sent off in the first half for arguing calls.

Maradona led Napoli to its only two Serie A titles in 1987 and 1990.

At the very least, Napoli is aiming for a top-three finish to get back into the Champions League, having reached the knockout stage last season before being eliminated by eventual champion Chelsea.

Last season, Napoli finished fifth in Serie A.

Juventus beat Roma and old rival Zdenek Zeman 4-1 on Saturday, while struggling AC Milan gave up a lead in a 1-1 draw at Parma.

BARCELONA, Spain (AP) - Valladolid thrashed visiting Rayo Vallecano 6-1 with two goals each by Oscar Gonzalez and Manucho on Sunday, breaking a two-game losing streak in the Spanish league.

"My team played intelligently. It knew how to interpret the game," said Valladolid coach Miroslav Djukic, who watched the match from the stands while serving a suspension for complaining about the referee.

"We avoided making mistakes and were very efficient in attack, combining well and entering from the flanks."

Also, Granada beat Celta Vigo 2-1 for its first win this season.

BIRMINGHAM, England (AP) - Darren Bent came off the bench to earn Aston Villa a point with a late goal in the 1-1 tie with midlands rival West Bromwich Albion in the Premier League on Sunday.

The England striker scored on a left-foot shot from close range in the 80th minute, denying West Brom a victory that would have lifted the team to third place.

Shane Long put the visitors ahead in the 51st, guiding home a low finish after Ron Vlaar's attempted clearance flew straight at him.

Villa has won just one of its first six games under new manager Paul Lambert and stayed in 15th place in the 20-team standings. West Brom is sixth, its best top-flight start since the 1978-79 season.

AMSTERDAM (AP) - U.S. striker Jozy Altidore raised his Dutch league-leading goal total to eight with a first-half score for AZ Alkmaar in the team's 3-3 tie with RKC Waalwijk on Sunday.

BERLIN (AP) - Alexander Meier scored twice for Eintracht Frankfurt to beat Freiburg 2-1 on Sunday, extending the promoted team's unbeaten start to the Bundesliga.

Max Kruse gave visiting Freiburg a 1-0 lead in the 50th minute, scoring with an angled shot from a rebound after Sebastian Freis' initial effort was saved.

Meier tied the score in the 68th.

Oczipka delivered the corner for Meier to score again five minutes later.

PARIS (AP) - French leader Marseille's perfect start to the season came to an emphatic end Sunday, when it lost 4-1 to Valenciennes with goalkeeper Steve Mandanda making a huge blunder.

Gael Danic and Anthony Le Tallec put Valenciennes 2-0 up after 35 minutes, and Mandada then rolled the ball out straight to Foued Kadir for the Algeria midfielder to make it 3-0.

Le Tallec scored his second of the game midway through the second half.

Marseille won its opening six matches.
