WASHINGTON (AP) ? Americans will soon be able to test themselves in the privacy of their own homes for the virus that causes AIDS, now that the Food and Drug Administration has approved the first rapid, over-the-counter HIV test.

The OraQuick test detects the presence of HIV antibodies using a mouth swab and returns a result in 20 to 40 minutes.

Government officials estimate that about 240,000 people, or one-fifth of the roughly 1.2 million people carrying HIV in the U.S., don't know they are infected. Testing is a chief means of slowing new infections, which have held steady at about 50,000 per year for two decades.

FDA officials said the test is designed for people who might not otherwise get tested.

"The availability of a home-use HIV test kit provides another option for individuals to get tested so that they can seek medical care, if appropriate," said Dr. Karen Midthun, director of the FDA's Center for Biologics Evaluation and Research.

Orasure plans to start selling the test in October, both online and through retailers like Walgreens, CVS and Walmart. It hasn't set a price yet but expects the consumer version to cost less than $60 but more than the one marketed to health professionals, which costs about $17.50. CEO Doug Michels said the price increase will help pay for a toll-free call center to provide counseling and medical referrals to test users.

"Each of the call-center operators is bilingual in English and Spanish, they've gone through 160 hours of training on HIV counseling and testing," Michels said in an interview with the Associated Press. "So they are highly trained professionals and they'll be there to support the consumer."

Michels said the company's marketing efforts will focus on populations at greatest risk of being infected with HIV, including gay and bisexual men, African Americans and Hispanics.

FDA stressed in its approval announcement that the test is not 100 percent accurate in identifying people with the virus. A trial conducted by test maker Orasure showed OraQuick detected HIV in those carrying the virus only 92 percent of the time, though it was 99.9 percent accurate in ruling out HIV in patients not carrying the virus.

That means the test could miss one in 12 HIV-infected people who use it but would incorrectly identify only one patient as having HIV for every 5,000 HIV-negative people tested, the FDA said.

People who test negative should get re-tested after three months, because it can take several weeks for detectable antibodies to HIV to appear, according to Dr. Jonathan Mermin, director of the Centers for Disease Control and Prevention's HIV unit.

The FDA has approved several other HIV test kits designed for home use, but they usually require a blood sample that must be sent to a laboratory for development.

HIV awareness groups hailed the approval as an important step in expanding testing for the virus.

"This test will allow anyone to empower themselves to know their HIV status when, how and with whom they want to," said Tom Donohue, founding director of Who's Positive.

Experts say it's difficult to predict how widely the test will be used.

According to the Orasure's study, 41 percent of people who discovered they were HIV-positive using OraQuick had never been tested. The company estimates that 9,000 new HIV carriers would be identified for every 1 million people who use the test.

Based in Bethlehem, Pa., Orasure has marketed a version of OraQuick to doctors, nurses and other health care practitioners since 2002. When used by professionals, the test is shown to accurately identify both carriers and non-carriers 99 percent of the time. It's not clear why the test is less accurate in consumer trials, but researchers said they expected its sensitivity to drop when it was used by consumers.

HIV eventually develops into AIDS, unless treated with antiviral drugs. AIDS causes the body's immune system to breakdown, leading to infections which become fatal.

Shares of Orasure Technologies rose 60 cents, or 5.2 percent, to close at $12.10 on Tuesday.

Mich. grandma to be tried in teen's shooting death

BLOOMFIELD TOWNSHIP, Mich. (AP) ? With her grandson's terrified screams filling a suburban Detroit courtroom, 74-year-old Sandra Layne sat in a jail jumpsuit with tears in her eyes Monday as she listened to the teen telling a 911 operator he'd been shot by his grandmother.

Tapes of the emergency call were played publicly for the first time at the hearing, during which Layne was ordered to stand trial on murder and weapons charges in the death of 17-year-old Jonathan Hoffman. Layne, petite with graying red hair, was acting in self-defense, her attorney later told reporters.

"I've just been shot. My grandma shot me. I'm going to die. Help," Jonathan yelled into a cellphone on May 18 from the condo he shared with his grandparents in West Bloomfield Township, an upscale suburb.

A few minutes later, he tells the operator: "I got shot, shot again. Please help. Help," before his voice trails off and a woman's shouts are heard in the background.

But it was what Layne told police when they arrived that convinced Judge Kimberly Small to order the frail grandmother to stand trial. Officer Derrick Kassab testified that Layne walked out of her home with her hands up and "screamed to me, 'I murdered my grandson.'"

Kassab was among several officers called to the stand during Monday's hearing, and their testimony revealed a bloody crime scene in a community of manicured lawns, quiet neighborhoods and lush green golf courses.

When Layne walked through the condo's front door, "she had blood on her hands, had some blood on her clothing," Officer David Curry said. He testified that there was also blood on a Glock 9mm semiautomatic handgun that officers found just inside the door. Nine spent cartridge cases also were found in the house.

Blood was found on walls and the floor throughout the home. Officers found Jonathan lying face down in an upstairs loft bedroom, his arms at his sides on the floor near a sofa.

"His legs moved just a little bit," Sgt. Joseph Spencer testified.

An autopsy revealed that Jonathan was shot three times in the chest, once in the abdomen and once in his left arm. The teen also had traces of synthetic marijuana in his urine, tests showed.

At one point, Small granted Layne's defense attorney a short break to allow his client to compose herself. Friends and relatives quietly sat behind her in the small courtroom, their eyes also red from crying.

Layne was being held without bond. If convicted, she could face up to life in prison.

After the hearing, defense attorney Jerome Sabbota indicated to reporters that Layne's actions were in self-defense.

"If you listen closely to the 911 tape, he's grabbing onto her and he's holding her. He's not letting her go," her lawyer said.

The shooting was the second time this year that officers were called to the home.

On March 21, officers responded to complaints and found Jonathan outside. Layne told police she was having a hard time because her grandson was very upset and yelling. No arrests were made that day.

Four days earlier, Jonathan, who was a senior at a local alternative high school, was pulled over in nearby Farmington Hills and ticketed for possession of marijuana and drug paraphernalia. He later received a 93-day suspended sentence and was placed on 12 months' probation.

Jonathan was living with Sandra Layne and her husband, Fred, while his mother and father were divorcing and living outside Michigan. Neither appeared to be in court Monday.

"This was a child who was dumped on her," Sabbota said. "She killed a person she loved that she tried to save.

"There are no winners. No matter what we do to her, it doesn't really matter. Watch her. She's in her own hell. Nobody wins this case."

In Vilma?s new lawsuit against the NFL, a copy of which PFT has obtained, lawyer Peter Ginsberg details every alleged flaw in the case against Vilma, and to a certain extent the other players suspended for involvement in the Saints bounty program.

Heavy on factual contentions and light on legal theories, the lawsuit requests only two things:? (1) an order of ?specific performance? requiring Goodell to rule on the bounty appeals; and (2) a temporary restraining order and preliminary injunction preventing the league from implementing the suspension against Vilma if the suspension is upheld.

Along the way, Ginsberg makes the following claims on behalf of Vilma:

1.? Vilma was willing to meet with Goodell before the one-year suspension was imposed, but Vilma wanted to review in advance the materials gathered by the league ??which the NFL contend[ed] provided a basis to investigate Vilma.??? In exchange, ?Vilma offered to provide the NFL with complete ?detail[] [of] Vilma?s knowledge regarding [the Bounty Program] allegations.?? The league declined to do so, so Vilma declined to meet with Goodell.

Opponents say cemeteries are hallowed ground that shouldn't be sullied by drilling activity they worry will be noisy, smelly and unsightly. Defenders say the drilling is so deep that it doesn't disturb the cemetery and can generate revenue to enhance the roads and grounds.

"Most people don't like it," said 70-year-old Marilee Pilkington, who lives down the road from the cemetery in rural Poland Township and whose father, brother, nephew and niece are all buried there.

"I think it's a dumb idea because I wouldn't want anyone up there disturbing the dead, number one, and, number two, I don't like the aspect of drilling," she said.

Township trustees received a proposal this year to lease cemetery mineral rights for $140,000, plus 16 percent of any royalties, for any oil and gas. Similar offers soon followed at two other area cemeteries.

Longtime Trustee Mark Naples felt the same way as Pilkington when the issue arose ? despite the fact $140,000 could cover the cemetery's budget, minus road maintenance, for more than 20 years.

"Our concern was we weren't going to let anybody come in there and move anything" in the cemetery, he said. "They weren't going to have my vote for that."

John Campbell, a lease agent for Campbell Development LLC, a company based in Fort Worth, Texas, declined a request for more information on his proposal, which was not expected to stir any graves. He said only that the offer was not accepted.

It was just more fuel for drilling opponents in the Youngstown area, already rocked by a series of earthquakes that have been tied to deep-well injection of wastewater from hydraulic fracturing and other drilling activities. They're now fighting for a citywide drilling ban.

Concerns are driven largely by a lack of information, said John Stephenson, president of the Texas Cemeteries Association.

"A lot of it just has to do with the way that it's presented," he said. "You're hundreds of feet below the ground, and it's not disturbing any graves."

It's possible to reach oil and gas deposits now from drilling rigs placed sometimes miles away because of advances in what's called horizontal drilling. The technology has made vast new shale energy deposits available under the Northeast, Texas and elsewhere.

Stephenson leased mineral rights under two of his cemeteries within the past three years, he said. Each is about a century old and populated with 75,000 graves. Revenue from the leases ? he wouldn't say how much ? has allowed him to pave roads, repair fences and make other improvements during economic hard times.

The Catholic Cemeteries Association in Pittsburgh also saw benefits to leasing mineral rights under 11 of its cemeteries comprising more than 1,200 acres. The five-year lease, signed in 2008, came to light through news reports in 2010.

David Shields, a city councilman at the time, was able to push through a citywide drilling ban amid the outrage stirred up by the debate.

"Everybody (in the press) liked the ghoulish aspects of drilling on sacred ground and disturbing great-grandma's body and all that," Shields said. "I'd say there were many other issues of greater immediate concern, but that's what the hook to it was."

In Poland Township, officials were full of questions: Could they legally sell the mineral rights to a public cemetery? What claim would families with burial plots have to the royalties?

"You know what it is, it's emotional," Poland Township Administrator Jim Scharville said. "A lot of people don't want any type of drilling. There's something about disturbing the sanctuary of a cemetery. We're not talking about dinosaurs now and creatures that roamed the earth millions of years ago. We're talking about loved ones who have died, people we knew."

Plot owners have no legal claim to the mineral rights at a cemetery, Stephenson said. Their agreements are for an indefinite rental of sorts at the surface level ? and a promise the site will be maintained, he said.

The Ohio township was also worried about not acting, Scharville said, out of fear the oil and gas could be claimed through mandatory pooling and they would wind up with nothing. Under such laws, well operators can seek underground access to properties without the owner's permission through a state review board.

The inability to control mineral rights has also become a concern in Colorado, where the National Cemetery Association, which operates veterans' cemeteries, is working to select a site for a new cemetery.

One of four prospective sites, in Fountain, could have been open to drilling because the mineral rights weren't free and clear, said Glenn Madderom, the agency's chief of cemetery development and improvement service. That presented a disincentive, even though its owners plan to donate the land at no cost to the government.

"Certainly you don't want oil drilling operations occurring on a property where it could be disruptive to the services or to the visitors, to the serenity or the peace of the site," Madderom said. "A national cemetery, we call it a national shrine. It's a beautiful, well-maintained property that honors the veterans and their families, and so oil drilling operations on that site are just not appropriate."

The administration also successfully fought to move drilling operations to the other side of a forest abutting the veterans' cemetery in Natchez, Miss., to preserve the mood, he said. Such sites are all eventually listed on the National Register of Historic Places.
