Credit Suisse loses bid to narrow National Century trial

(Reuters) - Credit Suisse Group Inc lost its bid to sever National Century Financial Enterprises Inc co-founder Lance Poulsen as a defendant in an upcoming scheduled trial over fraud at the health care services company a decade ago.

Thursday's decision by U.S. District Judge James Graham increases the potential that evidence harmful to the Swiss bank's defense may be introduced at the trial, where Credit Suisse faces a potential $2 billion of exposure.

The state of Arizona, AllianceBernstein Holding LP , Lloyds TSB Bank Plc , MetLife Inc , Allianz SE's Pimco unit and other bondholders accused Credit Suisse, once a placement agent for National Century bonds, of deceiving them about that company and missing its estimated $2.9 billion fraud.

Poulsen co-founded National Century in 1990, and is the only other defendant remaining in the case. He is serving a 30-year prison term and is presumed insolvent.

Montana Tech Announces Local Football Signings

Three athletes from Glacier and one from Flathead have committed to play football at Montana Tech in Butte next year, the school recently announced.

Rial Gunlikson, Reid Siderius and Todd Shelton from Glacier and Matthew Tokarz from Flathead have signed on to play for the Orediggers after high school. Will Davey from Polson has also committed to play for longtime head coach Chuck Morrell.

The current group of local signees increases Morrell?s recruiting class to 22 for 2013.

?Things are moving very fast for us in the recruiting process right now. I believe we have secured some excellent commitments that bring balance to our team as a whole,? Morrell said in a statement.

Tokarz, a 6-foot, 185 pound quarterback and safety for the Braves, plans to play wide receiver for the Orediggers, according to the school. He will play in this summer's Shrine game. As a junior, he was selected second team all-conference and all-state honorable mention as a quarterback. This past fall, he earned second team all-conference and all-state honorable mention as a safety. He finished third at the state track meet last spring in the triple and long jump. The son of Raymond Tokarz and Eileen Ciancido, Tokarz will major in business at Tech.

Gunlikson, a 6-1, 190 pound strong safety, was a team captain on Glacier's top-seeded semifinal playoff team last season. As a junior, he was selected second team all-conference and an honorable mention all-state. This past season, he was named first team all-state. He will play in both the Shrine Game and the Montana-North Dakota All-Star Game. Gunlikson participates in track and field. He was selected All-Conference in the triple and high jump last spring. The son of Rial and Kimberly, Gunlikson was named academic all-state twice in football and track and is a member of the National Honors Society.

Siderius, a 6-4, 185 pound defensive back, will play corner for the Orediggers. Last season, he led the state in interceptions with eight. He was selected first team all-state for the Wolfpack. Like Gunlikson, he will play in both the Shrine Game and the Montana-North Dakota All-Star Game. The son of Joan and Mike, he holds a 3.7 GPA and is a member of the National Honors Society. He will major in Applied Health Science.

Todd, a 6-3, 210 pound defender, was named second team all-conference and honorable mention all-state last season. He participated in track and field placing fourth at state last spring in the javelin. The son of Joseph and Roschelle, he has a 3.85 GPA and was named academic all-state three times and is a member of the National Honors Society. He will major in Applied Health Science.

Davey, a 6-1, 175 pound wide receiver and safety, will play safety for the Orediggers. Davey was a two-year all-state selection and the 2012 Co-Defensive MVP for Class A. Davey was a four year letter recipient in basketball as well as an exceptional tennis player. He has a first and fourth place divisional medals and a third at state. Davey will play in the Shrine game. The son of Steve Davey and Angie Stilson, Davey will major in biological sciences.

Man of Steel Writer ?Adores? Donner Films But Wanted More Real ...

Man of Steel MaybeSince the launch of the New 52, DC Comics has gotten quite a bit of mileage out of the idea that Superman would be a scary thing to come face to face to for the first time?and the revelation that Superman is an alien? Well, that would just be off the charts for many people.

It appears that Man of Steel is playing with a numebr of the same ideas, as screenwriter David Goyer told Empire Magazine this week (via CBM).

?We?re approaching Superman as if it weren?t a comic book movie, as if it were real,? said Goyer, who worked with producer Christopher Nolan on Man of Steel after the pair finished their work on the Dark Knight Trilogy. ?I adore the Donner films. Absolutely adore them. It just struck me that there was an idealist quality to them that may or may not work with today?s audience. It just struck me that if Superman really existed in the world, first of all this story would be a story about first contact.?

The writer added, ?He?s an alien. You can easily imagine a scenario in which we?d be doing a film like E.T., as opposed to him running around in tights. If the world found out he existed, it would be the biggest thing that ever happened in human history. It falls into that idea of trying to humanize the inhuman. He?s made out of steel, he?s not made out of flesh, metaphorically speaking. We are portraying him as a man, yet he?s not a man.?

That?s a pretty clear perspective on the character, although one that some readers might not agree with. That said, developing that approach was more difficult than figuring out how they wanted to approach Batman years ago.

?It is obviously a much longer process with a character like Superman. It is much easier to do a realistic take on Batman. You know nothing can hurt Superman, presumably other than Kryptonite,? Goyer said. ?The challenge was simply: can we figure out a way to make those elements work, quote unquote, in the real world? It?s very much a story of a man with two fathers.?

As the NFL and the NFLPA continue to stare at each other like the boys and girls pressed against opposite walls of a middle-school dance on the issue of HGH testing, Congress is getting closer to pushing the walls together, Star Wars Episode IV-style.? (I thought twice about making that reference because of the nerdish connotation.? But I?ve learned to embrace my nerdishness.)

For now, the wall that?s moving is the one behind the players.

?We are disappointed with the NFLPA?s remarkable recalcitrance, which has prevented meaningful progress on this issue,? Representatives Darrell Issa (R-Cal.) and Elijah Cummings (D-Md.) said in a letter to the NFL Players Association.? ?We intend to take a more active role to determine whether the position you have taken ? that HGH is not a serious concern and that the test for HGH is unreliable ? is consistent with the beliefs of rank and file NFL players.?

The NFL and NFLPA agreed in August 2011 to commence HGH testing.

?Despite being the first of the major professional sports leagues to agree to test for HGH, the NFL has now fallen far behind its counterparts in implementing the agreement,? the letter continues. ?While NFLPA management may not believe that HGH is a problem in the NFL, the words of your athletes suggest otherwise.? We hope the facts collected by the Committee will provide you and the NFL with the information necessary to resolve this matter.?

The letter also asks the NFLPA to produce a variety of documents and other information, including the NFLPA?s most recent proposal for HGH testing and information regarding any proposals exchanged between the NFL and the NFLPA during meetings that were planned for the week of January 21.? (It?s unclear whether any meetings actually happened.)

Congressional involvement in the form of a hearing at which players would testify is something about which both the NFL and the NFLPA should be deeply concerned.? If players are using HGH and they tell the truth to Congress, it makes the league and the union look very bad.? If players are using it and they lie, the players expose themselves to potential criminal prosecutions.

There?s no reason for the impasse to continue.? The NFLPA has said that it will accept HGH testing under the standards and procedures implemented by major-league baseball.? The NFL has indicated that would be sufficient.? So why not get together ? this week in New Orleans ? to hash out the details?

If not, players could be getting together in Washington to do something far less pleasant for everyone.

A safer way to vaccinate

Tuesday, January 29, 2013

Vaccines usually consist of inactivated viruses that prompt the immune system to remember the invader and launch a strong defense if it later encounters the real thing. However, this approach can be too risky with certain viruses, including HIV.

In recent years, many scientists have been exploring DNA as a potential alternative vaccine. About 20 years ago, DNA coding for viral proteins was found to induce strong immune responses in rodents, but so far, tests in humans have failed to duplicate that success.

In a paper appearing in the Jan. 27 online issue of Nature Materials, MIT researchers describe a new type of vaccine-delivery film that holds promise for improving the effectiveness of DNA vaccines. If such vaccines could be successfully delivered to humans, they could overcome not only the safety risks of using viruses to vaccinate against diseases such as HIV, but they would also be more stable, making it possible to ship and store them at room temperature.

This type of vaccine delivery would also eliminate the need to inject vaccines by syringe, says Darrell Irvine, an MIT professor of biological engineering and materials science and engineering. "You just apply the patch for a few minutes, take it off and it leaves behind these thin polymer films embedded in the skin," he says.

Irvine and Paula Hammond, the David H. Koch Professor in Engineering, are the senior authors of the Nature Materials paper. Both are members of MIT's David H. Koch Institute for Integrative Cancer Research. The lead author of the paper is Peter DeMuth, a graduate student in biological engineering.

Gradual vaccine delivery

Scientists have had some recent success delivering DNA vaccines to human patients using a technique called electroporation. This method requires first injecting the DNA under the skin, then using electrodes to create an electric field that opens small pores in the membranes of cells in the skin, allowing DNA to get inside. However, the process can be painful and give varying results, Irvine says.

"It's showing some promise but it's certainly not ideal and it's not something you could imagine in a global prophylactic vaccine setting, especially in resource-poor countries," he says.

Irvine and Hammond took a different approach to delivering DNA to the skin, creating a patch made of many layers of polymers embedded with the DNA vaccine. These polymer films are implanted under the skin using microneedles that penetrate about half a millimeter into the skin ? deep enough to deliver the DNA to immune cells in the epidermis, but not deep enough to cause pain in the nerve endings of the dermis.

Once under the skin, the films degrade as they come in contact with water, releasing the vaccine over days or weeks. As the film breaks apart, the DNA strands become tangled up with pieces of the polymer, which protect the DNA and help it get inside cells.

The researchers can control how much DNA gets delivered by tuning the number of polymer layers. They can also control the rate of delivery by altering how hydrophobic (water-fearing) the film is. DNA injected on its own is usually broken down very quickly, before the immune system can generate a memory response. When the DNA is released over time, the immune system has more time to interact with it, boosting the vaccine's effectiveness.

The polymer film also includes an adjuvant ? a molecule that helps to boost the immune response. In this case, the adjuvant consists of strands of RNA that resemble viral RNA, which provokes inflammation and recruits immune cells to the area.

Eliciting immune responses

In tests with mice, the researchers found that the immune response induced by the DNA-delivering film was as good as or better than that achieved with electroporation.

To test whether the vaccine might provoke a response in primates, the researchers applied a polymer film carrying DNA that codes for proteins from the simian form of HIV to macaque skin samples cultured in the lab. In skin treated with the film, DNA was easily detectable, while DNA injected alone was quickly broken down.

"The hope is that that's an indication that this will translate to large animals and hopefully humans," Irvine says.

The researchers now plan to perform further tests in non-human primates before undertaking possible tests in humans. If successful, the vaccine-delivering patch could potentially be used to deliver vaccines for many different diseases, because the DNA sequence can be easily swapped out depending on the disease being targeted.

"If you're making a protein vaccine, every protein has its little quirks, and there are manufacturing issues that have to be solved to scale it up to humans. If you had a DNA platform, the DNA is going to behave the same no matter what antigen it's encoding," Irvine says.

China Online Game Market Cross 51B, Web Game Splashing on ...

Last year Chinese game market size reached RMB 51.8 billion, according to a recent report by iResearch, a Beijing-based market researcher. With the rate of increase slowing down to less than 20%, the market growth has started to level off.

We also spotted some other interesting findings from the report; keep reading to find out more.

The first two charts (pictured below) elucidate online gaming market trend from 2007 to 2016 in general. As shown, overall company revenues are rising slightly quicker than the whole paid game market in China, mainly due to the extra income companies pulled in from cooperation platforms or overseas markets.

In terms of market share, client games are no longer the lonely players as it is since 2007, a more diversified market took its shape over the past decade with new game genres like social games, web games and mobile games flooded into the market. In 2012, web games grabbed 12.6% of China?s game market, which could be seen as a significant point. iResearch predicted that web games will keep this momentum and remain a 15% share in 2013. The current marketing practice and channels hinder web game market from moving further, claimed the report.

Chart1: Chinese Online Gaming Market Scale 2007-2016

Green: company revenue (in 100 million)

?

Chart2: Market Shares of the Paid Market 2007-2016

Green: client games(%) Red: platform(%) Yellow: web games(%) Blue: social games(%)

?

The third chart compared ad expenditure of client games and web games over the past few years. Client games threw away RMB 560 million in 2008 in marketing, while web games spent only 30 million for the same purpose in that year. But that?s probably because web game is still in its infancy stage, cause in 2012, web game bleed RMB 370 million in marketing while for client games the figure shrank to RMB 460 million.

iResearch explained that the increasing players of web games might have accounted for the rising costs of marketing in this area.

Chart3: Ad expenditure on Client Games And Web Games 2008-2012

Green: client games(in 100 million) Yellow: web games(in 100 million)

Paid market for mobile games reached RMB 5.21billion last year, in which smartphone games cover 12.5% market share. The growing penetration rate of smart phones in China may have paved the way for the popularity of smartphone games. iResearch believes that the transplant of massively multiplayer online?games onto mobile platform has proved its potential, which could lead the whole subsegment to keep growing.
